TERMS AND CONDITIONS

The following conditions listed below concerns the air transport services sold by Searcharter LTD directly or through its affiliated agents. The customers that make a booking for any of the air transport Services distributed by Searcharter undertake to read and accept the following Terms and Conditions.

BOOKING AND TRAVEL INFORMATION

Customers that want to perform a booking for a flight distributed by Searcharter, can purchase the tickets through the website www.searcharter.com or through the agent’s network.

Booking Process

The booking shall be considered as confirmed only when the customer receives the email confirmation through the email address provided during the booking process.

The confirmation email message contains the flight information for the flight booked and one or more booking identifier codes.

Whether the confirmation email requires the customer to submit the passenger identity documents details the customer has to fulfill with the procedure stated in the aforementioned email.

Please note: Searcharter shall not be retained responsible in the case of denied boarding caused by lack of information and/or inaccuracy of the documents data.

The email confirmation is considered the final step of the booking process and, except whether otherwise specified in the same email, customers are not required to perform any additional operation.

The customer can check the status of its booking through the “check your booking” tool available on the Searcharter website by specifying the required credentials.

Check-in

All the check-in operations shall be conducted at the check-in desks of the departure airport identified by the flight number reported in the confirmation email sent by Searcharter. Searcharter does not support on-line check-in as well as any boarding pass issuing process.

Check-in operations would required passengers to state their booking codes as well as the Identity documents at the check-in desks of the departure airport.

Please note: each departure or destination country may require specific documents and/or special visa requirements; the passengers are responsible to check that they holds all the necessary documents and fulfil with all the requirements stated by the destination and departure countries.

Baggage allowances

All the non-restricted fares distributed by Searcharter include a cabin baggage and a checked baggage. The baggage allowance for each flight is specified in the flight details. The hand baggage can be carried by the passenger onboard of the aircraft while the checked baggage can be delivered to the check-in desks during the check-in procedures. Each partner airline may accept more than one checked baggage as well as exceeding weight limit baggage against the payment of additional fees; for any information about the costs the customer can contact the Searcharter customer service (info@searcharter.com).

Special assistance

Whether a passenger requires any type of special assistance it is mandatory to contact Searcharter through the customer service (info@searcharter.com) almost 7 days before the scheduled departure time in order to ensure the proper supply of the special assistance.

GENERAL CONDITIONS

General conditions for passengers and customers that purchases the flight solution distributed by Searcharter LTD directly or through the affiliated agents network.

The customer of www.searcharter.com website may perform reservations and buy tickets on-line for flights listed in the website by Searcharter LTD.

Searcharter LTD is the owner of the website available at the following URL: www.searcharter.com.

The terms and the conditions listed below concerns the air transport services sold by Searcharter LTD and its affiliated agents, and are valid for all the flight solutions distributed by Searcharter LTD and supplied by or on behalf of the Searcharter partner providers.

The above mentioned partner providers shall be intended as the responsible entities as prescribed by law for the air transport service providers.

Searcharter LTD shall not, in any case, be held responsible for the supply of the flight operations that are carried out by partner providers and/or by the operating carriers for which Searcharter LTD issues tickets.

It being understood that the following conditions shall be considered as an explication of the operations related to the supply of the air transport service and that the same conditions are, in any case, subject to the “General conditions of carriage” applied by each operating carrier and published by each operating carrier.

Terms and definitions

Ticket: “ticket” means the receipt, provided with an alphanumeric identification code, sent by Searcharter LTD to the passengers after the end of all the booking procedures. The ticket shall indicate the PNR (Passenger Name Record) that is the electronic proof that entitles the passenger specified passenger to avail of the air transport services purchased.

Whether the confirmation email requires the customer to submit the passenger identity documents details the customer has to fulfill with all the procedures stated in the aforementioned email. Searcharter shall not be retained responsible in the case of denied boarding caused by lack of information and/or inaccuracy of the documents data.

Hand luggage: “hand luggage” means a luggage that the passenger can carry by hand on board of the aircraft.

Registered baggage: “registered baggage” means the baggage delivered to the check in desks of the departure airport. The check in desks issues a receipt of such delivery, the baggage is embarked in the aircraft, held by the airport staff and delivered to the passenger in the baggage hall of the arrival airport.

Reservation: “reservation” or “booking” refers to the set of procedures related to the choice of flight and the purchase of the ticket for a specific flight.

Fare type: “fare type” means a number of services related to the air transport services and including the air transport service itself. Each fare type may include air transport service for passenger with a hand luggage only or the same air transport service with one or more additional services.

Flight operator: “Flight operator” or “partner airline” or “operating carrier” means the operator of a flight for which Searcharter LTD has the right to issue tickets.

Acceptance of the following transportation conditions

The transportation conditions are available online on www.searcharter.com website and must be read by the customers before performing any booking. The booking constitutes full acceptance of these transportation conditions. These terms and conditions may be updated or changed at any time by Searcharter LTD. The transportation conditions that are valid at the time of the booking remains valid for each ticket issued prior to each amendment.

Tickets purchase

Searcharter LTD issues tickets against payments for each reservation performed through www.searcharter.com website and/or through the network of affiliated agents.

The tickets are issued only when the payment is performed and the same payment is verified by Searcharter LTD. Searcharter LTD will send a confirmation email, for each booking purchased on www.searcharter.com website or through the affiliated agents, to the email address provided by the passenger during the booking process.

Each confirmation contains an alphanumeric identifier code for the ticket related to the reservation, the passenger must show that code at the check-in desk of the departure airport with its identity documents.

Fares

The prices applied by Searcharter LTD for each fare are the same shown during the booking process and paid at the same time of the purchase. The fares prices of the may vary over time and be subject to the seats availability on each flight. No additional fee will be applied by Searcharter LTD and/or by the operating carrier after the purchase of the ticket, except in the case of the passenger decides to purchase additional services that are not included in the fare paid.

The prices shown for the fare purchase during the booking process includes all costs related to air transport service, any fuel surcharge, airport fees and VAT where applicable; nonetheless some agents that distributes the Searcharter fares may apply additional commissions to the bookings; nonetheless some countries deliberately decide to impose on each departing, arriving and/or transit passenger, some extra “tourist fees” that shall be intended, where applied, as a state tax excluded by the air transport service supplied.

The fares are differentiated into Fare Types.

Each Fare includes the air transport service for the passengers included in the booking with a hand luggage and may include ancillary service as hereby specified.

Fare Types applicable to flights for which Searcharter LTD issues tickets are:

  • “Economy with restrictions”
  • “Economy without restrictions”
  • “Economy Premium”
  • “Business Class”
  • “First Class”

Each Fare Type includes the following services:

Economy with restrictions: the air transport service for a passenger with a hand luggage only.

Economy without restrictions: the air transport service for a passenger with a checked baggage and a hand luggage.

Economy Premium: the air transport service for a passenger with an upgraded checked baggage, a hand luggage, and upgraded inflight service where provided by the operating carrier.

Business Class: the air transport service for passenger with an upgraded checked baggage, a hand luggage, and upgraded inflight service. The passenger has the right to sit on a seat more spacious than economy class seats, positioned in the business class area of the aircraft. The “extra leg” seats are not intended as business class seats.

First Class: the air transport service for passenger with an upgraded checked baggage, a hand luggage, and upgraded inflight service. The passenger has the right to sit on a seat more spacious than economy class seats positioned in the first class area of the aircraft. The “extra leg” seats are not intended as first class seats.

CHANGES AND CANCELLATIONS

Any modification and/or cancellation or refund for tickets issued by Searcharter LTD is not permitted. It is not granted any right of withdrawal to the passengers or customers that purchases the tickets issued by Searcharter LTD; in case of flight cancellation, overbooking and denied boarding the provisions of EU Regulation 261/2004 are applied. In case of denied boarding and/or flight cancellation for reasons related to flight safety and/or adverse weather conditions the provisions of EU Regulation 261/2004 shall not be applicable. In cases where the scheduled flights operations are affected by operational changes Searcharter LTD is responsible to communicate the changes to passengers through the contact information provided by the passengers during the reservation process.

Check in

The passenger must perform the check in operations to the check-in desks of the departure airport at least 2 hours (unless otherwise specified) before the scheduled departure time of the flight and no later than 40 minutes before the scheduled departure time of the flight. The passenger must provide to the check in desks of departure airport the alphanumeric identifier of the reservation and the identification documents.

Accepted travel documents

The accepted Travel documents are:

For all adult passengers:

  • a valid National Identity Card: for flights operated between countries belonging to the European Union Schengen Area;
  • a valid Passport: for flights operated between countries belonging to the European Union Schengen Area and non European countries;
  • any document required by any local body, governmental authority or other relevant authority.

For accompanied minors with age between 15 to 17 years:

  • a valid National Identity Card, if accompanied by a parent only.
  • a valid National Identity Card and a form collected from police of written authorisation to travel from their parents, if not accompanied by a parent. This form will need to be presented at the passport control.
  • any document required by any local body, governmental authority or other relevant authority.

For infants under the age of 2 years and children aged between 2 and 14 years:

  • Individual Passport or an equivalent document or the birth certificate with a photo issued by the municipality. The birth certificate with photo is a valid document for foreign travel when compiled and validated by the police. In cases where the names of the accompanying persons are not shown on the back of the above mentioned document, the passenger must have another document issued by the Police, stating the names of persons authorized to accompany the child.
  • any document required by any local body, governmental authority or other relevant authority.

Please note: each destination country may require specific documents related to the passenger.

It shall be considered Passenger responsibility that the passenger must ensure to be in possession of any document required by the legislation of the countries of destination for entry into their territory and to fulfill with any requirement imposed by any local body, governmental authority or other relevant authority.

It being understood that, whether the passengers fails to fulfill with any of the aforementioned requirements the operating carrier is entitled to deny the boarding of the relevant passengers without giving right to any compensation.

Security controls and Boarding

Each passenger must undergo all the security checks carried out by the airports touched by the flight for which the passenger performs a booking. It is passenger responsibility to be compliant with any security law and requirement applied by each departure and/or arrival country.

Denied boarding or limitation of carriage

The carrier may deny boarding or continuation of carriage for passengers or baggage or cancel a booking whether:

  • a) it is necessary for reasons of safety or public order;
  • b) it is necessary to avoid the violation of the laws of a state of departure, arrival or overflight;
  • c) the conduct, status or the mental or physical conditions of the passenger are liable to:
    • make it necessary a special help that the carrier can not provide, or
    • create significant or repeated inconveniences, or
    • expose himself to danger and/or other passengers and/or flight personnel or objects.

It being understood that, whether any of the passengers is involved in any of the aforementioned situations the operating carrier is entitled to deny the boarding of the relevant passengers without giving right to any compensation.

Baggage

The baggage allowed on board of flights for which Searcharter LTD issues tickets are:

  • One hand baggage for each passenger, except where otherwise specified. which must be hand-carried by the passenger in the aircraft’s cabin.
  • One Checked Baggage, except where otherwise specified, which must be delivered to the check-in desks of the departure airport. The check in desks issues a receipt of such delivery, the baggage is embarked in the aircraft, held by the airport staff and delivered to the passenger in the baggage hall of the arrival airport.

Hand luggage

Each passenger may carry in the aircraft’s cabin a hand luggage only except where otherwise specified. The dimensions of the hand baggage may vary from an operating carrier to another and all the dimensions and weight are listed in the dedicated page on the Searcharter website.

Checked baggage

In compliance with the restrictions provided by the Fare Type, each passenger can carry one or more checked baggage, by delivering them at check-in desks. The dimensions of the hand baggage may vary from an operating carrier to another and all the dimensions and weight are listed in the dedicated page on the Searcharter website.

Sport equipment and extra baggage

It is possible to purchase ancillary services in addition to air transport ticket such as the transportation service for sport equipment and/or additional baggage for flights for which Searcharter LTD issues tickets, subject to the availability of the same services.

To purchase additional services the passenger needs to contact the customer support through e-mail at info@searcharter.com or can contact the call center through the number +44 20 352 95 286 provided in the booking confirmation.

Each extra baggage shall be subject to a carriage fee for each flight except where otherwise specified and such carriage fee may vary from airport to airport and from operating carrier to another.

Sport equipment shall be subject to a carriage fee for each flight except where otherwise specified, such carriage fee may vary from airport to airport and from operating carrier to another.

Each baggage and any of such extra baggage must be delivered in compliance with any security requirements specified by the relevant operating carrier.

In cases where a loss of a registered baggage occurs, the flight operator will apply the provisions of EU Regulation 889/02, where applicable, and the Montreal Convention.

Infants, passengers with reduced mobility, special needs and special assistance

Passengers under the age of 2 years old, infant:

Passengers under the age of 2 years old can travel for free sitting on the lap of a parent, the parent is responsible for the correct safety position of the infant during take-off and landing phases, and during flight.

Each parent, for safety reasons, can hold a single infant only.

Strollers can be carried on board of the aircraft only if the strollers are completely foldable. Strollers must be delivered to the cabin crew during the boarding procedures. The crew members will correctly store the strollers in the cabin, and will return it during the disembarkation.

For each infant is it possible to transport liquids and medicines if necessary.

As a courtesy for passengers some operating carriers may accept baby seats onboard of their flights. Please contact info@searcharter.com or +44 20 352 95 286 in order to have information about the flights on which the seats are accepted.

For each type of special assistance, for information about how to travel with infants, assistance for pregnant women, for passengers with disability, for passengers with ambulatory difficulties, and transport of wheelchairs passengers should contact the support at info@searcharter.com or through the telephone number +44 20 352 95 286 before making reservations.

Passengers with reduced mobility and passengers with wheelchairs need assistance during boarding and disembarkation procedures. This kind of assistance is provided by the airport operators upon request by the flight operator.

Passengers that need assistance must inform Searcharter LTD about their needs; Searcharter LTD will process the requests and will send it to the flight operator. Special assistance may be booked through Searcharter LTD with an email to info@searcharter.com or through the telephone number +44 20 352 95 286 also provided in the confirmation email.

Each request must be received no later than 72 hours prior to scheduled departure time of each flight. Seats are subject to limitation. A failure to report the special request needs may imply the non-availability of the service at the departure airport and, subsequently the refusal of carriage of the passenger.

Passengers who are blind, deaf or deaf-mutes

The passenger must indicate its status both at the time of booking and at the time of check-in at the departure airport.

It is possible to board the aircraft with guide dogs for the blind and/or deaf; passengers must report in advance the need to travel with a guide dog by contacting Searcharter LTD at info@searcharter.com or through the telephone number +44 20 352 95 286 within 72 hours before the flight departure time; each request must be received no later than 72 hours prior to scheduled departure time of each flight.

Seats are subject to limitation; a failure to report the special request needs may imply the non-availability of the service at the departure airport and, subsequently the refusal of carriage of the passenger.

The dog must wear the appropriate identification harness and be compliant with all the requirements imposed by each relevant operating carrier. Whether on board of the aircraft there are no free seats for guide dogs, they must remain on the floor at the foot of the passenger.

Pregnant women

For safety reasons and to avoid health damage, the carrier reserves the right to provide the transport service for pregnant women:

  • before the 23th week are accepted on board of the aircraft with a medical certificate attesting to the week of pregnancy;
  • from 23th to 33th week is required a medical certificate attesting to fitness to fly;
  • after the 33th week – under no circumstances are permitted to fly on board of the aircraft.

In all the cases of pregnancy a certificate attesting to fitness to fly and issued by a doctor is requested.

Unaccompanied minors

The transport of Unaccompanied Minors (UM) may be supplied onboard of some of the flights for which Searcharter LTD issues tickets, subject to the availability of the same service if supplied by the operating carrier; to have information about the availability of this service please contact Searcharter LTD at info@searcharter.com or through the telephone number +44 20 352 95 286; additional fees may be applied for the supply of such service; the Unaccompanied Minors service is subject, where available, to a fee of per flight that may vary for each relevant operating carrier. For passengers, whose physical or mental conditions requires special care on board of the aircraft or during embarking or disembarking procedures, it is necessary to submit the certificate attesting to fitness to fly signed by the physician. Passengers whose behavior or whose state or physical or mental conditions may render them incapable of caring for themselves without assistance or may be a risk to themselves or others, or may be a risk for the safety of the flight must travel necessarily accompanied.
